Colorado Supreme Court engages in insurrection

By Scott Tibbs, December 23, 2023

The utterly ridiculous decision removing Donald Trump from the primary and general election ballot in Colorado is naked election interference preening as serious jurisprudence. Of course, it backfired, and the "justices" effectively gave the Trump campaign an enormous in-kind contribution. If there was ever any doubt that Trump would easily win the Republican nomination, the so-called "justices" erased it. Plus, the Supreme Court will almost certainly reverse the decision.

Before I get further, I want to address Vivek Ramaswamy preening for MAGA voters by proudly announcing he refuses to compete in Colorado and demanding his Republican rivals do the same. This would be the worst decision they could make and makes Trump's primary opponents into nothing more than fans orbiting around him. Ramaswamy feels he needs to parade his virtue by announcing he will not compete in a primary he has no chance of winning. Following his lead, I proudly announce I will also not run for President next year.

Doug Wilson made a similar demand:
But so do all those never-Trump evangelicals. If they are not the loudest voices in opposition to this, standing against this naked assault on our freedoms, then they will have done nothing but add their names to history’s long roster of quislings and rotters—a roster already too long.
Wrong.

Nobody is obligated to "denounce" or "speak out" against anything. That is literally the same tactic Black Lives Matter has used for three years, demanding people "speak up" against whatever they want denounced. Silence is not "violence," and no one is obligated to speak just because someone demands it. This is how a cult behaves.

Here is the obvious problem for people cheering this decision: Trump was never convicted of participating in an insurrection against the federal government. Trump explicitly told his supporters to "peacefully and patriotically" march to the Capitol Building to make their voices heard. The Colorado "justices" denied due process to Trump, stripping him of his right to fairly compete and disenfranchising every voter who would have supported him in that primary. The fact that the "court" made this decision without any criminal conviction illustrates that the "ruling" is totally corrupt.

The other problem is how radically the language of "insurrection" has been expanded. Many Democrats have claimed (laughably) that sitting members of Congress who cast a legal vote against certifying the election are "insurrectionists." If voting against certification is illegal or even amounts to treason, why have the vote at all? It seems like the people who are so concerned about election integrity and respecting democracy only respect votes they like.

The four "justices" who ruled against Trump should be impeached and disbarred in the state. That will not happen, but it should. Everyone knows that removing Trump from the ballot absent an actual conviction for insurrection is nonsense, whether they want to admit it or not. In our legal system, justices cannot pretend someone is guilty of a crime when he has not been convicted of that crime. In Trump's case, he has not even been charged with that crime.

As I have said many times over the last couple years, I am not a Trump supporter. I wish Republicans would pick someone else to be the party's standard-bearer in 2024. But opposition to Trump, not matter how terrible you think he is, actually does not allow for the termination of all rules, regulations, and articles, even those found in the Constitution. Many of the same Leftists who clutched their pearls when Trump said that on Truth Social are cheering the 4-3 decision to terminate Trump's due process rights.

The lawfare unleashed against Trump over the last couple years is ridiculous and needs to be stopped. This includes impeaching and disbarring both corrupt "judges" and corrupt prosecutors. If it continues, Republicans will be incentivized to engage in similar behavior, and "red states" could retaliate by disqualifying Joe Biden to be on the ballot. Democrats are sowing the wind, and will have no credibility to complain when they reap the whirlwind.
